Terms and Conditions

Agreement to Terms

By accessing the Randy Van Duinen Workshops website, registering for a workshop, purchasing an online training course or other product or service, making a payment, or participating in a workshop or related activity, you agree to these Terms and Conditions.

We may update these Terms and Conditions from time to time. The most current version will be available on our website.

Eligibility and Participant Conduct

Participants must be at least 18 years of age unless accompanied by a parent or legal guardian.

By registering for a workshop, you acknowledge that you are physically capable of participating in the workshop activities and understand that photography, travel, and outdoor activities may involve inherent risks.

Participants are expected to treat fellow attendees, instructors, guides, local residents, service providers, and the locations we visit with respect. Randy Van Duinen Workshops reserves the right to remove any participant whose behavior is disruptive, unsafe, unlawful, or negatively impacts the experience or safety of others. No refund will be provided if a participant is removed for these reasons.

Payments and Cancellations

Workshop deposits, tuition, and payment schedules are outlined on each individual workshop page. A participant's place in a workshop is not confirmed until the required registration and deposit have been received.

Cancellation requests must be submitted in writing.

Unless otherwise stated for a specific workshop, the following cancellation and refund policy applies:

  • More than 150 days before the workshop: Full refund of payments made, less any non-refundable processing or administrative fees.

  • 150–91 days before the workshop: Refund of payments exceeding 50% of the total workshop tuition.

  • 90–61 days before the workshop: Refund of payments exceeding 75% of the total workshop tuition.

  • 60 days or less before the workshop: No refund.

 

Some workshops may have different or non-refundable payment terms due to accommodations, transportation, reservations, permits, or other advance commitments. When applicable, those terms will be clearly stated on the individual workshop page.

If a canceled participant's place is filled by another participant, Randy Van Duinen Workshops may, at its discretion, provide an additional refund, less any non-refundable expenses and administrative or processing fees.

Workshop Changes and Cancellations

Workshop itineraries are subject to change due to weather, transportation schedules, government regulations, local conditions, safety concerns, supplier changes, or other circumstances beyond our control. Randy Van Duinen Workshops reserves the right to modify the itinerary, schedule, locations, accommodations, transportation, instructors, or other workshop arrangements when reasonably necessary.

If Randy Van Duinen Workshops cancels a workshop, participants will receive a refund of amounts paid directly to Randy Van Duinen Workshops for that workshop. Our responsibility for a canceled workshop is limited to those amounts and does not include airfare, additional hotel stays, travel insurance, visa or passport fees, equipment purchases, or other personal travel expenses.

We may substitute accommodations, instructors, guides, transportation providers, photographic locations, or scheduled activities when necessary due to availability, safety, weather, local conditions, or circumstances beyond our control.

For these reasons, we strongly recommend purchasing appropriate travel insurance to help protect your additional travel expenses.

International Travel

Many of our photography workshops take place outside the United States. Participants are responsible for obtaining and maintaining all documents, insurance, and other requirements necessary for international travel, including:

  • Valid passports

  • Required visas or travel authorizations

  • Required travel documentation

  • Compliance with entry requirements and local laws

  • Travel insurance

  • Medical insurance appropriate for international travel

 

Participants are responsible for verifying current entry requirements, passport validity requirements, visa requirements, and travel restrictions for all destinations included in their trip.

Randy Van Duinen Workshops is not responsible for a participant's inability to enter or remain in a destination because of missing, expired, or insufficient travel documentation or failure to meet applicable entry requirements.

Assumption of Risk

Photography workshops may involve activities and conditions that carry inherent risks, including hiking, walking on uneven terrain, exposure to changing weather conditions, travel in vehicles or other forms of transportation, wildlife encounters, and activities in remote or unfamiliar locations.

By participating in a workshop, you acknowledge and voluntarily accept the risks associated with these activities and conditions. You are responsible for evaluating your own physical abilities, health, experience, and comfort level before participating in any workshop activity.

Participants are expected to follow reasonable safety instructions provided by Randy Van Duinen Workshops, instructors, guides, transportation providers, or other individuals assisting with workshop activities.

If you are uncomfortable with or unable to safely participate in a particular activity, please notify your workshop instructor.

Limitation of Liability

To the fullest extent permitted by law, Randy Van Duinen Workshops, its owners, instructors, employees, contractors, guides, and affiliates shall not be liable for any injury, loss, damage, delay, expense, or inconvenience resulting from circumstances beyond our reasonable control, including but not limited to:

  • Weather or natural disasters

  • Transportation delays, cancellations, or disruptions

  • Acts or omissions of hotels, transportation providers, guides, restaurants, or other third-party service providers

  • Government actions, travel restrictions, or changes in entry requirements

  • Illness, injury, medical emergencies, or evacuation

  • Lost, stolen, or damaged personal property or photography equipment

  • Changes to workshop itineraries, locations, accommodations, or scheduled activities when reasonably necessary

 

Participants are responsible for their own personal belongings, photography equipment, travel arrangements, and expenses not specifically included in the workshop.

To the fullest extent permitted by applicable law, our total liability arising out of or relating to a workshop shall not exceed the amount paid by the participant to Randy Van Duinen Workshops for that workshop.

Nothing in these Terms and Conditions is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

Participant Responsibilities

You are responsible for reviewing all pre-workshop materials, bringing the required photography equipment, personal items, and appropriate clothing, and maintaining respectful conduct toward fellow participants, instructors, guides, service providers, and the locations we visit.

Group Travel and Flexibility. You acknowledge that traveling with a group may require flexibility and compromise to accommodate the different goals, interests, personalities, and physical abilities of other participants. While our itineraries are carefully planned, they are intended as guidelines and may change based on conditions and photographic opportunities.

Changes may occur due to weather, geographic conditions, transportation, government restrictions, safety concerns, or other circumstances beyond our control. Workshop leaders and professional guides may make adjustments when reasonably necessary for the safety, comfort, or overall experience of the group. Such changes do not constitute grounds for refunds or discounts when scheduled activities, locations, or experiences are modified or curtailed.

Participants are expected to maintain appropriate dress, hygiene, and consideration toward fellow participants, instructors, staff, service providers, and the local communities and environments we visit.

If you choose double-occupancy lodging and we are unable to match you with a roommate, you may be responsible for the single-room supplement listed for that workshop.

Randy Van Duinen Workshops reserves the right to modify or cancel an activity or to restrict a participant from participating when reasonably necessary for safety, conduct, or the overall operation of the workshop. The workshop leader's judgment will be the final determination regarding a participant's ability to continue in a workshop or activity.

Photography Equipment

Participants are responsible for bringing, carrying, protecting, and insuring their own photography equipment and personal belongings. Randy Van Duinen Workshops is not responsible for lost, stolen, or damaged equipment or personal property, except where liability cannot be excluded under applicable law.

Drone Use: Drones may only be used when permitted by local laws, regulations, property owners, and workshop leaders. Participants are responsible for obtaining any required licenses, registrations, permits, or insurance and for operating their drone legally and safely. Drone use must not interfere with other participants or workshop activities.

Health and Medical Responsibility

Participants are responsible for determining whether they are physically capable of participating in workshop activities.

Any medical conditions, dietary restrictions, allergies, accessibility needs, or mobility concerns that may affect participation should be disclosed to Randy Van Duinen Workshops before the workshop begins.

Participants are responsible for obtaining any necessary medical care, prescriptions, vaccinations, and appropriate travel medical insurance.

If you have concerns about your ability to participate in a workshop, we recommend consulting your physician before registering or traveling.

Use of Images and Promotional Materials

Randy Van Duinen Workshops may photograph or record workshop activities for educational, promotional, archival, and marketing purposes.

By participating in a workshop, you grant Randy Van Duinen Workshops permission to use your image, likeness, and voice in workshop-related promotional and educational materials unless you notify us in writing before the workshop begins.

Participants retain full copyright ownership of the photographs they create during a workshop.

Randy Van Duinen Workshops will not sell, license, or otherwise use a participant's photographs for commercial or promotional purposes without the participant's permission.

Intellectual Property

All content created by Randy Van Duinen Workshops, including website text, photographs, videos, course materials, presentations, instructional materials, graphics, and other original content, is protected by applicable copyright and intellectual property laws.

Content may not be copied, reproduced, distributed, published, sold, or used for commercial purposes without prior permission from Randy Van Duinen Workshops.

Workshop participants may use instructional materials provided to them for their own personal and educational use but may not reproduce, distribute, or resell those materials.

Participants retain full ownership and copyright of the photographs they create during a workshop.

Third-Party Services

Randy Van Duinen Workshops may use third-party providers for accommodations, transportation, tours, guides, restaurants, payment processing, and other workshop-related services.

These providers operate independently, and Randy Van Duinen Workshops is not responsible for their acts, omissions, services, or policies, except where responsibility cannot be excluded under applicable law.

Travel Insurance

We strongly recommend that participants purchase comprehensive travel insurance that includes coverage for:

  • Trip cancellation and interruption

  • Medical expenses

  • Emergency medical evacuation

  • Lost or delayed baggage

  • Travel delays

 

Participants are responsible for selecting and purchasing insurance appropriate for their individual needs and travel plans.

Costs Not Included

Unless specifically stated on the individual workshop page, workshop tuition does not include:

  • Airfare and related fees

  • Optional activities or excursions

  • Passport, visa, or travel authorization expenses

  • Travel, baggage, or cancellation insurance

  • Personal expenses, including laundry, telephone charges, and alcoholic beverages

  • Meals not specifically listed as included

  • Any other items not expressly described as included

 

Participants are responsible for these and any other personal or incidental expenses incurred during travel.

Governing Law

These Terms shall be governed by the laws of the State of Michigan, USA, unless otherwise required by applicable law.

Any dispute arising from these Terms shall first be addressed through good-faith negotiation. If a resolution cannot be reached, the parties agree to pursue mediation or arbitration before commencing litigation, where permitted by law.

Severability and Assignment

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Randy Van Duinen Workshops may assign its rights and obligations under these Terms to an affiliated entity or successor.

Updates

We may update these Terms periodically. Continued use of our website or participation in workshops after updates constitutes acceptance.
